Terms and Conditions
These Terms govern access to Zeelark and the services made available through it. Read them with the Privacy Policy, pricing and risk disclosures, transaction confirmations, and any service-specific terms shown in the app.
1. Agreement and operator
Your agreement is with the legal entity identified as the operator of Zeelark in your account or service disclosures. "We", "us", and "our" refer to that operator and the relevant affiliate identified for a service. By creating an account, accepting these Terms, or using the service, you agree to these Terms. If you do not agree, do not create an account or submit an instruction.
A regulated provider, bank, card issuer, payment processor, crypto provider, custodian, or other partner may provide part of a service under separate terms. The app will identify those terms where applicable. Nothing in these Terms claims a licence, deposit guarantee, compensation scheme, or regulatory protection that is not expressly confirmed in the relevant service disclosure.
2. Eligibility
You must be at least 18, have legal capacity, use the account for yourself unless we approve another arrangement, live in a supported country, provide accurate information, and satisfy applicable verification and eligibility checks. You must not use the service where local law prohibits it.
3. Your account and information
Provide complete and accurate legal identity, contact, residential, tax, source-of-funds, and verification information when requested. Keep it current. We may require government identification, proof of address, a selfie, selfie video, bank statement, or other evidence. We can refuse, limit, or close an account if information is missing, inaccurate, inconsistent, expired, or cannot be verified.
You may hold only the number and type of accounts we permit. Your account is personal and may not be sold, transferred, rented, or used for another person's activity.
4. Security responsibilities
- Keep your password, authorization PIN, card PIN, one-time codes, device, email account, private keys, and recovery information secure.
- Do not share credentials with anyone, including a person claiming to work for Zeelark.
- Use app lock where appropriate, install updates, review trusted devices, and revoke access you do not recognize.
- Notify support immediately if a device, credential, card, account, or transaction may be compromised.
We may treat an instruction authenticated with the controls assigned to your account as authorized by you, subject to protections that applicable law gives for unauthorized transactions. Delayed reporting can reduce the chance of recovery and may affect rights where law permits.
5. Your instructions
Check every recipient, tag, bank detail, asset, network, wallet address, amount, currency, fee, and exchange rate before confirming. We may reject, delay, hold, cancel, or request more information about an instruction for security, limits, insufficient funds, technical failure, sanctions, fraud prevention, legal compliance, provider requirements, or an obvious error.
A submitted instruction is not completed until the app marks it successful or completed. Some instructions can be cancelled while pending; completed internal transfers, card transactions, bank payouts, and blockchain transactions may be irreversible. Contact support promptly, but recovery is not guaranteed.
6. Currency accounts and exchange
Supported account currencies and features can change. A display currency is for presentation and does not convert the underlying balance. Exchange quotes may expire or change until confirmation. The final confirmation shows the applicable rate, amounts, and fee. Rounding can apply at the supported currency precision.
The legal character of money held through the service, safeguarding arrangement, interest treatment, deposit insurance, and compensation protection depends on the provider and country disclosed for your account. Do not assume a balance is a bank deposit or protected by a compensation scheme unless the app expressly confirms it.
7. Payments and transfers
Internal transfers, payment requests, transfers between your accounts, and bank transfers are available only where shown. A payment request is not a payment and the recipient is free to decline it. Estimated arrival times are not guarantees. Banks, networks, counterparties, compliance reviews, cut-off times, holidays, and outages can cause delay.
You are responsible for lawful payment purposes and correct recipient details. We may correct duplicate or erroneous ledger entries and reverse a provisional credit where the underlying payment fails, is reversed, charged back, or was credited by mistake, subject to applicable law.
8. Cards
Card availability is subject to eligibility, issuer rules, and separate cardholder terms. A virtual card can be used only where the merchant and network accept it. Freezing can stop new authorizations but may not stop a transaction already authorized, an offline transaction, a refund, a chargeback, or another issuer-permitted entry.
Keep card details and PINs private. Card PIN changes require the verification shown in the app. We or the issuer may block, replace, suspend, or terminate a card for security, compliance, misuse, expiry, or account closure. Dispute a card transaction using the process and time limit stated by the issuer and applicable law.
9. Crypto services and risks
Crypto access can require a separate application, risk acknowledgements, and approval. Supported assets, networks, prices, providers, custody arrangements, limits, and transfer capabilities can change or be withdrawn. Use only the deposit address and network shown for the exact asset. An unsupported asset, wrong network, incorrect address, smart-contract issue, protocol event, or network failure can cause permanent loss.
Cryptoassets can be highly volatile, illiquid, technically complex, and exposed to cybersecurity, fraud, protocol, custody, counterparty, regulatory, tax, and market risks. You can lose all value committed to a crypto transaction. Blockchain transfers are generally irreversible and publicly observable. Network confirmation and withdrawal review times are estimates.
Unless expressly stated in a service-specific agreement, crypto content is general information and execution functionality, not personal investment, legal, accounting, or tax advice. Regulatory and compensation protections vary and may be unavailable. Consider independent advice and your ability to bear a complete loss.
10. Managed investment experience
Investment access is subject to eligibility, acknowledgements, review, and the position terms shown before submission. The current performance experience is generated by Zeelark's managed investment model and does not by itself represent direct ownership of externally executed securities. Modelled results, trader profiles, ratings, past performance, targets, and projections do not guarantee future outcomes.
A position can be under review, active, paused, rejected, completed, or settled. The position confirmation governs its amount, duration, fees, processing intervals, settlement, and any stated principal protection. Principal protection applies only where expressly offered and subject to the displayed conditions; it does not make every return or service risk-free. You remain responsible for deciding whether the product and risk are appropriate.
11. Fees, rates, limits, and taxes
We show applicable fees, rates, and amounts before confirmation where practicable. Third-party, network, bank, correspondent, card, blockchain, or tax charges may also apply. Limits can depend on verification, account history, risk, provider requirements, country, currency, asset, network, and service status. You are responsible for taxes and reporting unless law requires us to deduct or report them.
12. Prohibited use, restrictions, and recovery
You must not use the service for fraud, unlawful activity, sanctions evasion, abuse, unauthorized access, deceptive conduct, infringement, market manipulation, malware, or activity prohibited by a provider or applicable law.
We may place a hold, disable a feature, require reverification, suspend an account, revoke a session, block a card, restrict a withdrawal, or open a recovery case where reasonably required. We will provide notice and a review route where lawful and safe, but may be unable to disclose information that would compromise security, another person, an investigation, or a legal obligation.
13. Third-party services
The service may depend on banks, payment networks, card issuers, market-data providers, blockchain networks, identity providers, Google sign-in, Google Analytics, Chatway, Telegram, hosting, email, and other providers. Their separate terms and privacy notices may apply. We are responsible for our own obligations but do not control an independent network or provider and cannot guarantee its uninterrupted operation.
14. Availability, updates, and changes to services
We aim to keep the service available but do not promise uninterrupted or error-free access. Maintenance, security incidents, provider outages, network conditions, legal changes, and events outside reasonable control can affect availability. Install or refresh required updates promptly. We may add, change, suspend, or withdraw a feature with notice where reasonably practicable and subject to mandatory law.
15. Responsibility and liability
Nothing in these Terms excludes liability that law does not allow us to exclude, including liability for fraud or fraudulent misrepresentation, or removes mandatory consumer and payment rights. Subject to that rule, neither party is responsible for loss caused by the other party's breach, unlawful conduct, or failure to take reasonable security precautions.
To the extent law permits, we are not responsible for indirect or unforeseeable loss, changes in market value, loss caused by an incorrect recipient or blockchain address, unsupported network use, an independent provider or public network, tax consequences, or an event outside reasonable control. Any service-specific liability cap and exceptions must be stated in the final operator terms and applied consistently with mandatory law.
16. Ending the agreement
You may ask to close your account after settling pending obligations and moving eligible balances or assets. We may close or suspend the relationship for breach, risk, inactivity, legal requirements, provider withdrawal, or service discontinuation. We will provide legally required notice unless immediate action is permitted or required. Terms needed to settle transactions, resolve disputes, protect rights, or meet recordkeeping duties survive closure.
17. Governing law, support, and complaints
These Terms are governed by the law identified in the service-specific terms provided for your account, without removing mandatory rights you have in your country of residence. Start a complaint through the Help and support area in Zeelark and include the relevant transaction or ticket reference, but never include a PIN, password, or one-time code. The final service disclosures will identify any required external dispute-resolution service, financial ombudsman, regulator, or court.
18. Changes and general provisions
We may update these Terms for legal, regulatory, security, provider, product, or operational reasons. We will provide the notice and effective date required by law. If one provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer the agreement without consent; we may transfer it as part of a lawful restructuring or service transfer while preserving applicable rights.
